1. About these terms
These terms are an agreement between you and Prygenix Innovations Private Limited ("Prygenix", "we", "us"), a company registered in India, located in Bangalore, Karnataka, India. They apply when you use our websites (prygenix.com and products.prygenix.com), our licence service (licenses.prygenix.com), and when you buy or use our software products, such as Prygenix MEP Openings and Prygenix BIM Suite ("the Software"). By using our websites or the Software you accept these terms. If you use them on behalf of a company, you confirm that you may accept these terms for it.
Our Privacy Policy explains how we handle personal information.
2. Using our websites
- You may browse our websites and use the information on them for your own business purposes.
- Do not misuse them: no attempts to break in, overload or disrupt them, no automated scraping that harms the service, and no unlawful, misleading or harmful content sent through our forms.
- Website content is provided for general information. We work to keep it accurate but may change it at any time without notice.
- Links to other websites are provided for convenience. We are not responsible for their content or practices.
3. Software licences
The Software is licensed, not sold. Your use of it is governed by the End User Licence Agreement (EULA) that you accept when you install the Software or use it for the first time. You can read it any time in the Software (Prygenix tab › Licence › Licence agreement). If these terms and the EULA differ on the use of the Software, the EULA applies.
- Free trial: each product can be tried free of charge, with all features, for the trial period shown on its product page.
- Licence keys: a licence key is for the product, term and number of computers stated in your order. Each key may be active on one computer at a time; you can move it by deactivating it in the Licence window.
- Activation: activating a licence needs an internet connection once. The Software then works offline and checks the licence about once a week when online.
- Licence keys are personal to the buyer. You may not share, resell or publish them, or work around the licence checks.
4. Orders, prices and payment
- Prices, licence terms and what is included are those stated in our quotation or on the order page at the time you order. Taxes such as GST are added where they apply.
- Payment is made through the payment method or provider shown at checkout, or as agreed in our invoice. Your licence key is sent to the e-mail address in your order once payment is received.
- Fixed-term (for example annual) licences end at the end of their term unless renewed.
- If you get the Software from the Autodesk App Store, Autodesk's terms for that store also apply to the download.
5. Refunds
Because every product can be tried free of charge before buying, licence fees are not refundable once a licence key has been delivered, except where the law requires a refund or where we agree otherwise in writing. If a licence key does not work, or you were charged in error, contact support@prygenix.com and we will put it right.
6. Support and updates
We provide support by e-mail at support@prygenix.com and may release updates that fix problems, add features or support new Revit versions. We aim to support the Autodesk Revit versions listed on each product page; support for a Revit version may end when Autodesk stops supporting it.
7. Consulting and project services
BIM, digital twin, automation, development, 3D printing and other services are provided under a separate proposal, quotation or contract. That document sets the scope, fees, timelines and deliverables and takes priority over these terms for those services.
8. Intellectual property
Our websites, the Software, our logos and the name Prygenix belong to Prygenix or its licensors and are protected by law. You may not copy, modify or reuse them except as these terms or the EULA allow. The models, drawings and data you create with the Software belong to you.
Autodesk and Revit are registered trademarks of Autodesk, Inc. Prygenix is an independent company and is not affiliated with or endorsed by Autodesk.
9. Professional responsibility
The Software is a design tool. Openings, sizes, dimensions, tags, schedules and other results it produces must be checked by a qualified professional before they are relied on for construction or any other purpose. You remain responsible for your designs and for complying with the codes and standards that apply to your projects.
10. Disclaimer
Except as stated in the EULA or required by law, our websites, the Software and their content are provided "as is" and "as available". We do not promise that they will be free of errors or interruptions, or fit for a particular purpose.
11. Limitation of liability
To the extent permitted by law, Prygenix is not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, goodwill or business, arising from the use of or inability to use our websites, the Software or our services. Our total liability for any claim is limited to the amount you paid us for the product or service concerned in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.
12. Suspension and termination
We may suspend or revoke a licence, or block access to our websites or licence service, if they are used in breach of these terms or the EULA, for example with a shared, resold or fraudulently obtained licence key. You may stop using the Software at any time by deactivating and uninstalling it.
13. Changes to these terms
We may update these terms from time to time. The new version applies from the effective date shown on this page. Changes do not reduce the rights you already have under a licence you have paid for.
14. Governing law and disputes
These terms are governed by the laws of India. We will first try to resolve any dispute with you in good faith by e-mail or discussion. If that does not succeed, the courts in Bengaluru, Karnataka, India have exclusive jurisdiction, unless the law of your country gives you the right to bring proceedings where you live.
